Bernstein was initially convicted in 2022 of theft over $5,000, but that verdict was overturned on appeal due to legal errors. Facing the prospect of a new trial, prosecutors have now elected to withdraw the charge entirely, bringing the protracted criminal proceedings to a close.

While the criminal case is now ended, the episode underscores the severe personal and legal consequences that can arise when high-value real estate deals unravel.
