Buying a home with someone else has become a practical route for many people locked out of the market on their own. A 2024 Bankrate survey cited by NPR found that co-ownership is gaining ground, especially among younger buyers who face record home prices and wages that have not kept pace. Splitting a down payment and a mortgage can turn an impossible goal into a reachable one. The arrangement, however, carries risks that rarely surface until a disagreement does.
Shared ownership works smoothly while everyone agrees. Problems begin when priorities diverge. One owner may want to sell and cash out. Another may want to hold the property longer. A third might stop paying their share of the mortgage, taxes, or repairs. Personal circumstances shift as well. Relationships end, jobs move, and financial situations change. Without a written agreement covering these scenarios, the owners can find themselves stuck.
Legal experts say the most common mistake is relying on trust alone. A co-ownership agreement should spell out how decisions get made, how expenses are divided, what happens if someone wants out, and how disputes get resolved. Some owners use a tenants in common structure, which allows unequal shares and lets each person pass their portion to heirs. Others choose joint tenancy, which includes a right of survivorship.
When conflicts escalate, courts may order a partition sale, forcing everyone to sell whether they want to or not. That outcome can destroy both the investment and the relationship. The lesson is simple. Co-ownership can open doors, but only a clear plan keeps them open.
